LITTLEMISSMATCHED 2012 WHITE ZANY BICYCLE SWEEPSTAKES OFFICIAL RULES
1. NO PURCHASE NECESSARY
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. Odds of winning depend on the number of eligible entries received. By participating in the 2012 White Zany Bicycle Sweepstakes (the "Sweepstakes"), entrants (sometimes called "you" or "your") agree to comply with and are bound by these Official Rules and by the decisions of Miss Matched, Inc. ("Sponsor"). The Sweepstakes begins at 12:00 AM (EST) on January 6, 2012 and ends at 11:59 PM (EST) on January 31, 2012 (the "Sweepstakes Period").
2. WHO CAN ENTER
The Sweepstakes is open to legal residents of the contiguous United States. Limit one (1) entry per household. Children younger than thirteen (13) years of age at the time of entry must have permission of a parent or guardian. You must be a U.S. resident and physically reside in the contiguous United States during the Sweepstakes Period to be eligible to enter. Void outside the contiguous United States, in Puerto Rico and other US territories and possessions, and where prohibited by law. Employees of the Sponsor and the Sponsor’s respective affiliates, subsidiaries, parent companies, agencies and the families of such employees and those living in the household of same are not eligible to enter or win.
3. HOW TO ENTER
You may enter the Sweepstakes either online or at one of our retail stores during the Sweepstakes Period. To enter online, visit http://www.littlemissmatched.com/sweepstakes and enter a valid email address. To enter in stores, visit a participating LittleMissMatched retail store during normal business hours, and provide a valid email address to a LittleMissMatched sales associate. Any entries with an invalid email address will not be accepted. No form of entry other than specified in these Official Rules is permitted.
4. PRIZES.
The Sweepstakes has one (1) Grand Prize and five (5) Second Prizes. The GRAND Prize is the very first LittleMissMatched Bicycle designed exclusively by LittleMissMatched in its White Zany pattern (approximate retail value $89) and one (1) $100 gift card. Each Second Prize is one (1) $100 gift card. The GRAND Prize winner and each Second Prize winner may choose to receive the gift card prize as either a gift card for use in a LittleMissMatched retail store or an eGift Card for use online at http://www.littlemissmatched.com. Sponsor will ship all prizes via Standard Ground shipping at no cost to the winner or via email for eGift Card winners. Prizes are not transferable or redeemable for cash. No substitution of prizes is allowed by the winner, but Sponsor reserves the right to substitute a prize or prizes of equal or greater value. All expenses and taxes on prizes are the sole responsibility of the winners.
5. SELECTION OF WINNER
From all of the eligible entries received during the Sweepstakes Period, the Sponsor will randomly select one (1) entry to win the GRAND Prize and five (5) entries to win a Second Prize. The selection of winners shall take place within thirty (30) days of the end of the Sweepstakes Period. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules. The decisions of Sponsor shall be final and binding in all matters relating to the Sweepstakes. The odds of winning depend on the number of entries received.
Sponsor shall attempt to notify each prize winner within ten (10) business days of selection via email to the email address provided by you at the time of entry. Winner (and his/her parent/legal guardian) must sign and return any required documentation including, without limitation, an affidavit of eligibility, a liability release and a publicity release within ten (10) days after notification in order to accept his/her prize. If a potential winner fails to respond to Sponsor’s notification or accept the prize within ten (10) business days for any reason or if a prize or notification is returned as undeliverable, the prize is forfeited and Sponsor may choose to select an alternate winner in a random drawing of all remaining eligible entries received.
6. USE OF YOUR DATA
By entering, you agree that Sponsor may use your name and the entry information provided by you for marketing, promotional and other purposes without additional compensation or consideration to you, unless prohibited by law. Information entrants provide to Sponsor will be used to communicate with participant(s) in relation to the Sweepstakes as well as to inform both previous customers and current customers of Sponsor information which Sponsor believes may be of interest to them.
7. AGREEMENT WITH RULES AND LIMITATIONS OF LIABILITY
By entering, you agree to be bound by the decisions of Sponsor and agree to comply with these Official Rules and all applicable laws, and agree to, and do hereby, release and hold harmless Sponsor and its parent, subsidiaries, affiliates, employees, and agents, and each of its and their respective officers, directors, employees, and agents, from any and all liability, loss, damage, harm, or injury resulting from participation in this Sweepstakes and/or awarding, receipt, possession, use and/or misuse of a prize, including, without limitation, (a) personal injury, death, and property damage, (b) claims based on violation of publicity rights, defamation, or invasion of privacy, (c) lost, late, postage-due, misdirected, or undeliverable mail, (d) technical errors related to computers, servers, providers, or telephone or network lines, (e) printing errors, (f) typographical errors, however caused, in entries, and (g) errors in the administration of the Sweepstakes or the processing of entries. You waive any right to inspect or approve uses of your entry or to be compensated for any such uses, and hereby represent you have read and understand these Rules.
8. MISCELLANEOUS
Sponsor is not responsible for late, lost, delayed, incomplete, inaccurate, or misdirected entries or for human or machine errors, bugs or failures in submitting entries, or for errors in offering or administrating Sweepstakes.
Entries received by automated, programmed, robotic or like forms of entry will be disqualified. Proof of uploading will not be deemed to be proof of receipt by Sponsor. Illegible, incomplete, or inaccurate entries are void. Entry will be deemed to be made by the "account holder" of the email address submitted at the time of entry, in event of any dispute. The "account holder" is the natural person assigned to the e-mail address by an Internet Service Provider responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Sweepstakes should a problem arise beyond the control of Sponsor. Failure of Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. The prize is awarded "as is" with no warranty or guarantee, either express or implied, by Sponsor. Sponsor's decisions are final and binding in all matters relating to this Sweepstakes. Employees of Sponsor and/or its agents, affiliates, parent, sales representatives, marketing affiliates and partners, dealers, distributors, advertising and promotion agencies (and members of the immediate families or household of each) are not eligible to participate in the Sweepstakes. Any and all disputes, claims, and causes of action arising out of, or connected with, this Sweepstakes or the prize shall be resolved exclusively by state or federal courts situated in New York and any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but, in no event, attorneys' fees. No punitive, incidental, special, consequential or other damages, including, without limitation, lost profits, may be awarded. This Sweepstakes is governed by the laws of the State of New York without regard to its conflict of laws.
